In late September 2005, the ACLU of Missouri filed an amicus brief in state court, joined by the Electronic Frontier Foundation, supporting a motion to quash a local Prosecuting Attorney’s subpoena to Mark Twain Rural Telephone seeking to unmask the identity of an anonymous online critic. The anonymous critic in this action was engaged in political speech on a message board of the local television station and had criticized the subject of an investigation, a local judge, as well as the progress of the investigation and the prosecuting attorney conducting the investigation. Amidst substantial allegations of impropriety, there was additional concern that the prosecuting attorney was seeking to unmask the identity of the critic for purposes of retribution or harassment. Unfortunately for all concerned with privacy, the case was rendered moot when the ISP voluntarily provided the subscriber’s identity to the prosecuting attorney.
